Article (1): Preamble and Legal Acknowledgment
- These Terms and Conditions constitute a legally binding agreement between the operator of the Al Suroor Real Estate Platform (“the Platform”) and any user who accesses or uses its services.
- Use of the Platform constitutes final and unconditional acceptance of all provisions of this Agreement.
- The user acknowledges that:
- They have full legal capacity.
- They possess the legal authority to act in relation to the property being advertised.
- They bear full legal responsibility for all published information.
Article (2): Legal Nature of the Platform
- The Platform operates as an electronic technical intermediary for listing properties.
- The Platform is not a party to any sale, purchase, or lease agreement.
- The Platform does not guarantee:
- Valid ownership of any property.
- That the property is free from disputes or encumbrances.
- The legal validity of permits or title deeds.
- Any contractual relationship arises exclusively between the transaction parties.
Article (3): Compliance with Real Estate Brokerage Regulations
- Real estate brokers must include their official license number in advertisements.
- Advertisers are fully responsible for compliance with the Real Estate General Authority regulations.
- The Platform reserves the right to request official documentation for verification at any time.
Article (4): Verification and Compliance (KYC & AML)
- The Platform may request user identity verification.
- The Platform has the right to suspend any account suspected of involvement in:
- Money laundering
- Terrorism financing
- Real estate fraud
- Data may be shared with competent authorities in accordance with Saudi regulations.
Article (5): Content and Advertisements
Users are prohibited from:
- Publishing fake properties.
- Manipulating prices with intent to mislead.
- Posting inaccurate or misleading images.
- Advertising properties without legal authorization.
- Using the Platform for political or non-real estate promotional purposes.
The advertiser bears full civil and criminal liability for all published content.
Article (6): Fees and Financial Policies
- Certain services are paid services according to the announced pricing.
- All fees are non-refundable unless approved in writing by the Platform.
- The Platform reserves the right to modify prices without prior notice.
- Any financial dispute does not suspend payment obligations for other due fees.
Article (7): Limitation of Liability
- Services are provided “as is.”
- The Platform shall not be liable for:
- Direct or indirect financial losses.
- Failed transactions.
- Fraud between users.
- Technical malfunctions.
- In all cases, the maximum liability of the Platform shall not exceed the total fees paid during the preceding 12 months.
Article (8): Indemnification
The user agrees to indemnify and hold harmless the Platform, its owners, directors, and employees from any:
- Legal claims
- Fines
- Attorney fees
- Financial damages
Arising from violation of these Terms.
Article (9): Intellectual Property
- All rights related to design, software, and content are owned by the Platform.
- Copying or commercial use is prohibited without prior written consent.
Article (10): Data Protection
- The Platform complies with the Saudi Personal Data Protection Law.
- The user consents to the processing of their data for operating the Platform.
- The Platform is not responsible for any voluntary disclosure made by the user.
Article (11): Force Majeure
The Platform shall not be liable for delays resulting from:
- Government decisions
- Natural disasters
- Infrastructure failures
- Telecommunication service interruptions
Article (12): Suspension and Termination
The Platform may:
- Immediately suspend an account
- Remove listings
- Terminate subscriptions
- Block access
Without compensation in the event of violation.
Article (13): Governing Law and Jurisdiction
- This Agreement is governed by the laws and regulations of the Kingdom of Saudi Arabia.
- Exclusive jurisdiction lies with the competent courts within the Kingdom.
- The Platform may resort to arbitration where deemed appropriate.
Article (14): Amendments
- The Platform reserves the right to amend these Terms at any time.
- Amendments become effective immediately upon publication.
- Continued use constitutes implied acceptance.
